Terms and Conditions
TrueShares is a For Sale/Rent cooperative advertising company that is not a real estate broker. The cooperative advertising program involves pooling advertising resources with those of other sellers/renters to maximize exposure to potential buyers/renters of your vacation property.
TrueShares is not involved in any negotiation for sale/rent, closing, or procuring of buyers. TrueShares forwards all inquiries about your vacation property directly to you and allows you to negotiate the sale/rental of your vacation property.
TrueShares cannot and does not appraise the value/rental price of your vacation property. The sale/rental price of your property has been established by you, the owner, and TrueShares has made no representations as to the sale/rental price that you may receive.
Although your vacation property will be exposed to thousands of potential buyers/renters as a result of the TrueShares advertising program, TrueShares does not have a specific buyer/renter at the present time. We do not specifically go to your resort or vacation home to show your property.
TrueShares is not affiliated with your resort, personal vacation home, or other third party organization. TrueShares is not a real estate broker. TrueShares is an advertising company.
TrueShares has made no representations as to the period of time that it will take to sell/rent your vacation property, the success rate of our advertising program, or the sale/rental price that you may receive. The advertising period and sale/rental price are determined by market conditions and the size, location, resort, amenities, and week that you desire to sell/rent. Because we are an advertising company and are not involved in the sale/rental or the negotiation of the sale/rental, we are unable to provide you with statistics of the percentage of sales/rentals as a result of our advertising program.
TrueShares is an advertising company that does extensive advertising to drive buyers/renters to our website, call us by phone, or walk inside our office to view our inventory. TrueShares does not specifically advertise your property other than on our website. Your advertisement is on the TrueShares website, but not specifically on the resort's national and international advertising materials.
We presently have our main office located in Newnan, Georgia. In this office, guests can view videos, read printed material, and view our online inventory. Our sellers’ vacation property ads are available to be viewed on our website at our location and we have access to the RCI and II websites available for those who are interested in more information on timeshares in general.
All pricing decisions are the sole responsibility of the advertiser. Any figures given to an advertiser by an employee of TrueShares are averages based on actual advertised prices or actual completed sales and rentals. These figures are given to assist the owner in the advertisement pricing decision. The advertiser can make whatever use of this information they like. Advertisers may adjust their asking price anytime for no charge. We strongly encourage all advertisers to market their property at the fairest or lowest price possible to help ensure success.
TrueShares doesn't appraise or provide property value. The sale or rental price of an advertisement is established by the advertiser and we don't advise on whether a price needs to be changed in order to maximize the likelihood of sale or rental. TrueShares doesn't make any representations as to the likelihood of success of the advertisement you place on the TrueShares, the offer(s) that you may receive, or the amount of time it will take to sell or rent. The marketing period and price are determined by current market conditions, and the size, location, resort, amenities, and property that is advertised.
TrueShares doesn't identify specific buyers or renters.
TrueShares doesn't monitor individual advertisements or views per advertisement.
TrueShares doesn't qualify potential buyers or renters who respond to advertisements. Your interactions with persons interested in your advertised property are at your own risk, and TrueShares cautions you to take appropriate security measures. TrueShares recommends that you utilize the Buyer and Renter Broker Assist program when interacting with a potential buyer or renter.
TrueShares does not personally assist you in the sale or rental of your advertisement, including but not limited to showing your property, other than by posting on this TrueShares the property descriptions and photographs. However, our staff will assist potential buyers or renters in identifying advertisements from advertiser content that match's each buyer or renter's stated requirements. In doing so, TrueShares doesn't recommend one advertisement over another.
TrueShares isn't affiliated with your resort or any third party organization other than through our Buyer and Renter Broker Assist programs. TrueShares doesn't take part in any negotiation for sale or rental of an advertisement. Advertisers negotiate directly with the potential buyer or renter unless they have designated a broker to assist them with the negotiation.
If applicable, our lawyer will assist an advertiser in the process of transferring their ownership or their rental transaction.
If an advertiser chooses, they may elect additional types and levels of services which include:
Buyer and Renter Broker Assist program, by which licensed real estate agents, assist in screening and negotiating with prospective buyers or renters on behalf of the advertiser who has chosen to utilize broker assistance. The terms of any agreement between an advertiser and a real estate broker are not endorsed or recommended by TrueShares. If an advertiser accepts the services of a real estate broker, a commission, closing cost or other fees may be charged to the buyer and or seller.
TrueShares operates within the timeshare resale marketplace. Through cooperative advertising, TrueShares makes it possible for timeshare buyers, sellers and renters to connect around the world. The rack rate for a Platinum for sale advertisement is $1295 or $895 for a Gold for sale advertisement or $495 for a Platinum rental advertisement or $395 for a Gold advertisement. The fee is payable at the time the advertisement is purchased. TrueShares does not itself engage in real estate broker services on your behalf or anyone else. Since TrueShares is for sale or rent by owner company and does not provide real estate services, TrueShares has itself sold zero timeshare properties.
TrueShares is not a telemarketing company and does not solicit potential customers or initiate contact with them. The potential customer initiates contact with TrueShares, usually using information obtained from its website.
TrueShares does not invite potential customers to telephone it nor does it encourage such calls. It posts its phone number on its website and potential customers may make whatever use of that posting they desire.
TrueShares does not offer any gifts, awards, prizes or communications to potential customers which represents its services and which invites a response by telephone which is then followed by a call from a salesperson.
TrueShares does not invite a response by telephone in any written or oral notifications or advertisement directed to potential customers.
Refund Policy
TrueShares, will advertise your vacation property until sold or rented, or for up to twelve months, whichever occurs first. You may renew at no charge for another twelve months by giving us written notice thirty days before the first twelve months end. TrueShares, will refund one half of the advertising fee if your property is a Platinum Ad and is sold in any other way within 50% of the original sale price or within 25% of the original rental price upon proof of a bona fide sale or rental occurring during the original ad period. Otherwise, the ad fee is non-refundable. There is no guarantee that the property will sell or rent at any price.

TrueShares reserves the right to make changes in the programs, policies, content and/or services described on this web site at any time without notice. Anyone who uses, or makes decisions based on information contained in this web site does so at their own risk.

Limitation of Liability
Under no circumstances shall TrueShares be liable for any damages, direct, special, incidental, consequential, punitive or exemplary or otherwise, that results from the use of, or the inability to use, the materials on this web site, even if TrueShares authorized representative has been advised of the possibility of such damages.
This agreement shall be governed by and enforced in accordance with the laws of the Commonwealth of Florida. If a court of competent jurisdiction finds any part of this agreement void or unenforceable, the remainder should be enforced and the court should use its authority to amend it in order to fulfill the stated purposes of this agreement to the fullest extent permitted by law.
Indemnification
You will indemnify and hold harmless TrueShares, its parent, affiliated and subsidiary entities, and the successors, licensees, assigns, officers, and directors of each from and against any and all claims, losses and damages (including reasonable attorney's fees) constituting and arising out of a breach of any of the provisions of this Terms of Use, and/or from any and all use of TrueShares.
